Terms of Service
These Terms govern access to and use of Sempre Aberto, including its business directory, booking, events, local feed, news, communities, and messaging features.
1. Acceptance and eligibility
By accessing or using Sempre Aberto, you agree to these Terms and the Privacy Policy. If you do not agree, do not use features that require an account.
You must have legal capacity to accept these Terms. People under 18 should use the service with the knowledge and supervision of a legal guardian where applicable.
2. What Sempre Aberto provides
Sempre Aberto is a local platform for discovering businesses, opening hours and contact details; requesting appointments; finding and creating events; posting to feeds, news and communities; and exchanging messages.
The directory is publicly accessible. An account may be required to book, RSVP, post, vote, create communities, message others, or manage a profile.
3. Accounts and security
You must provide accurate information, protect your credentials, and notify us of unauthorized use. If you sign in with Google, the terms applicable to your Google account also apply.
You are responsible for activity under your account. We may restrict or suspend access where there is a security risk, fraud, a breach of these Terms, or a legal requirement.
4. User content
You retain your rights in text, events, and other content you publish. By publishing, you grant Sempre Aberto a non-exclusive, worldwide, royalty-free license, limited to the time and scope needed to host, technically adapt, display, and distribute that content within the service and in promotion directly related to it.
You represent that you have the rights and permissions needed to publish the content and that it is truthful to the best of your knowledge. Public content may be viewed, shared, and indexed by search engines.
5. Prohibited conduct
You may not use the service to:
- engage in illegal, fraudulent, discriminatory, threatening, or abusive activity;
- publish another person's personal data without a legitimate basis, harass or stalk others, or impersonate anyone;
- send spam or malware, publish deceptive content, or manipulate votes, ratings, or metrics;
- infringe copyright, trademarks, privacy, or other rights;
- access accounts, systems, or data without authorization, bypass limits, or interfere with the service;
- automate high-volume collection or publication without express authorization.
6. Businesses, local information, and bookings
Listed businesses and professionals are independent from Sempre Aberto. Hours, ratings, prices, availability, addresses, and contacts can change; confirm important information directly with the business.
A booking request does not guarantee service until confirmed by the provider. Sempre Aberto facilitates contact but is not a party to the service between you and the business and is not responsible for its performance, quality, safety, or legality, without limiting mandatory rights under Brazilian law.
Business representatives must provide truthful data and may be required to prove their relationship to a business before managing its profile.
7. Events, location, and safety
Event creators are responsible for the title, date, venue, accessibility, permits, and safety of their activities. An RSVP is not a guarantee that an event will occur.
Location may be used to validate event creation or access to a live event conversation. Do not use this feature where it would put you or others at risk.
8. Moderation, blocking, and reports
We may review reports; remove, preserve, or reduce the reach of content; restrict features; suspend accounts; and cooperate with authorities where needed for safety, legal compliance, protection of third parties, or enforcement of these Terms.
Blocking does not automatically erase previously shared history. Group administrators may add or remove members and moderate content within the service's limits.
9. Intellectual property
The software, visual identity, Sempre Aberto name, and original platform elements belong to their respective owners and are protected by applicable law. These Terms do not transfer intellectual property ownership to you.
10. Third-party services and links
The platform may use or link to third-party services such as Google for authentication, OpenStreetMap for maps, and local source websites. Those third parties operate under their own terms and policies. We do not control external pages.
11. Availability and changes
The service is provided as available. We may fix, update, limit, discontinue, or change features while preserving accrued rights and providing notice where required by law. We do not guarantee uninterrupted or error-free operation.
12. Liability
To the maximum extent allowed by law, we are not liable for indirect loss, lost opportunities, or user and third-party content or conduct outside our reasonable control. Nothing in these Terms excludes liability that cannot lawfully be excluded or limits mandatory consumer rights.
13. Termination
You may stop using the service at any time and request account closure. Some information may be retained where necessary for legal obligations, fraud prevention, safety, the exercise of legal rights, or preservation of other users' legitimate content.
14. Governing law and changes to these Terms
The laws of the Federative Republic of Brazil apply. For consumer relationships, the legally competent forum of the consumer's domicile remains available.
We may update these Terms to reflect service or legal changes. Material changes will carry an updated date and appropriate notice. Continued use after the effective date means acceptance where permitted by law. For users in Brazil, the Portuguese version controls if translations conflict.
